Protection Under the Law from Creditor Harassment

Anyone who has fallen behind on payments for their home, car, credit cards or medical bills has, no doubt, had to endure numerous collection calls that just don't seem to stop. The calls are often aggressive, upsetting and can cause a serious disruption to your life. Once you file a petition for bankruptcy, however, all collection activity is required to stop. This is called the "automatic stay."

The Automatic Stay

An automatic stay takes effect upon the filing of your bankruptcy petition. A notice is sent to all your creditors, immediately halting most collection actions. This includes all phone calls, letters, lawsuits, and repossession activity. A creditor's failure to comply with the automatic stay essentially constitutes a violation of a court order.

Creditor harassment is taken very seriously by the court. If a creditor continues to pursue collection activity after they have been notified of the automatic stay, you may be entitled to ask the bankruptcy judge for damages including costs and attorney fees.
