Chapter 13 bankruptcy, also referred to as "federal debt consolidation," can be a good option for a person who has a regular income but is having trouble keeping up with his or her payments. Chapter 13 allows you to keep your property by repaying your debts over three to five years according to a plan approved by the bankruptcy judge. If you are unable to pay all of your debts within the maximum 5 year period of a Chapter 13, you may pay less than 100% of unsecured claims to keep your payment within your budget. It is worth noting that in a Chapter 13, the interest on unsecured debt stops when the case is filed.
